Guardianships are typically required in these situations:
- An individual with disabilities, who cannot make their own healthcare and financial decisions, turns 18, necessitating their caregiver to undertake the formal guardianship process to continue making such decisions legally.
- When an individual is incapacitated due to illness or injury and lacks a valid durable power of attorney or healthcare directive, or if there is no living or capable agent to act on their behalf.
- A minor who inherits real property not within a testamentary or revocable trust, and the property must be sold.
